On February 04, 2011 Cassational Board of Almaty City Court has considered an appeal of Bank of Development of Kazakhstan and six its heavy borrowers, related to judgment of economic court and cassational board rule. An appeal was dismissed, judgment and rule were affirmed.
Bank of Development of Kazakhstan and its six heavy borrowers such as, JSCs “Kaustic”, “Agromashholding”, Companies “Biokhim”, “Youteks”; LLPs “Silitsium Kazakhstan” and “Kazakhcement” have brought a suit against owner of the newspaper “Central Asia Monitor”, LLP “Alem BG” about protection of honor, dignity, business reputation and recovery of KZT350000000 (USD2380952) as moral damage to Specialized Inter District Court of Almaty.
The charges stemmed from articles “Time presses. Does time wait till is over?” (28.08.2009), «Listen to advice, but do one's own thing” (04.09.2009), «A time to gather stones, or what Bank of Development of Kazakhstan made in Kazakhstan?” (15.09.2009), «Everything is not solved with the help of money (21.09.2009), «In waltz time” (22.09.2009), «Fair game and unfair one” (29.09.2009), «Chained» (06.10.2009), «BDK: strange sympathy to “Kazakhcement” (07.10.2009.) by Alan Beketov.
On August 23, 2010 Specialized Inter District Economic Court of Almaty has dismissed a suit of joint-stock company "Bank of Development of Kazakhstan" and six its heavy borrowers. On November 25, 2010 Board of Appeal of Almaty City Court has considered the appeal of plaintiffs, related to this judgment. The appeal was dismissed comprehensively.
On February 04, 2011 a ruling of Specialized Inter District Economic Court of Almaty entered into effect. Servicemen of Bank of Development of Kazakhstan could file a supervisory appeal to supreme court till August 23, 2011.
