There was legal proceeding by suit of Internet-users to Ministry of Communication and Information of Republic of Kazakhstan

There was a legal proceeding by suit of Eugeniya Plakhina to Ministry of Communication and Information of the Republic of Kazakhstan in Almaly District Court №2 on June 02, 2010. The legal proceeding was adjourned till 09.30 a.m. on June 14, 2010. It was connected with absence of Representative Officers of Ministry of Communication and Information of the Republic of Kazakhstan. They did not come to court. Clerk of the court said that the suit was sent to defendant. But, court officers did not receive any reply on it.
The charges stemmed from restriction of the access to some Internet-resources for Kazakhstan's Internet-users; long-term blocking of forum-partner of the portal “Respublika”; barring of Internet-portal “Respublika” and some its “mirrors”, but, there was no any court decision and permission of its owner about suspension of these web-resources.
Plaintiff thought that defendant should make state and technical control in connection's sphere by legal way; did not take any measures of restoration of constitutional rights of Internet-users for free getting of information. There was also information on suspension of blocking of these resources.
Eugeniya Plakhina made an appeal of proofs giving in the court room. As a result of it the court could visit websites and checked over them with a list, concerning accessibility and non-accessibility.
Lawyer of International Foundation for Protection of Freedom of Speech “Adil Soz” Ganna Krasilnikova gave legal support.
In May 2010 Internet-users of all regions of Kazakhstan, Astana and Almaty; there were more 120 suits, which were addressed to Ministry of Communication and Information of the Republic of Kazakhstan. It tried to confute this information. Servicemen of Ministry of Communication and Information of the Republic of Kazakhstan said that they received a suit of Medeu District Court of Almaty on May 27, 2010.
