International Foundation for Protection of Freedom of Speech «Adil Soz» has conducted analysis of\r\nviolations of right to freedom of expression, receiving and dissemination of\r\ninformation in December, 2016 in Kazakhstan.

There was following\r\ninformation:
\r\n\r\n
- The resident of Pavlodar Ruslan Ginatullin was sentenced to six years\r\nof deprivation of liberty for re-post of video references these video\r\nreferences were posted in the open access on YouTube. His lawyer thought that\r\nhis client was condemned “for his actions in the past”.
\r\n\r\n
- The Appellate Instance of court of Astana has acquitted judgment which\r\nwas awarded with regard to Chairman of Union of Journalists of Kazakhstan\r\nSeitkazy Matayev and General Director of IPA «KazTAG» in a part of deprivation from right to hold executive\r\npositions, related to organization-distributive and materially-responsible\r\nfunctions in the state agencies from life ban up to ten years; in other part\r\njudgment was upheld.
\r\n\r\n
-Ex- Head of Department of Health Care System of South Kazakhstan Oblast\r\nDzhumagali Ismailov demanded KZT30000000 from editor-in-chief of the newspaper «Caravan» Igor Shakhnovich and\r\njournalist Ermek Kasymov.
\r\n\r\n
In December, 2016 four judicial acts towards cases over protection of\r\nhonour, dignity and business reputation were passed. And six ones were passed\r\nin favour of media outlets, journalists and citizens.
\r\n\r\n
Since the beginning of the year in connection with execution of right to\r\nfreedom of expression, receiving and dissemination of information, they were\r\nbrought:
\r\n\r\n
-50 charges with slander (23 – passing data);
\r\n\r\n
-3 charges with propaganda or public calls on forced seizure of power;
\r\n\r\n
-13 charges with incitement of social, religious and national enmity\r\n(article 174 of Criminal Code of the Republic of Kazakhstan); 3 of them are\r\npassing data S. Mambetalin, E. Narymbaev and E. Thaichibekov;
\r\n\r\n
-2 charges with propaganda of terrorism (1-passing data, B.\r\nSatkangulov);
\r\n\r\n
-12 charges with dissemination of knowingly false information (article\r\n274 of Criminal Code of the Republic of Kazakhstan;
\r\n-1 charge with evasion of the\r\npayment of taxes;
\r\n-1 charge with embezzlement of\r\nentrusted of the other property;
\r\n-2 charges with fraud;
\r\n-1 charge with extortion;
\r\nAnd etc.
\r\n-87 pre-trial claims and suits\r\non protection of honour, dignity and business reputation
\r\nFrom January-December, courts passed 52 judicial acts of suits on\r\nprotection of honour, dignity and business reputation (in first instance- 36)\r\nin the total amount of KZT866 millions 460 thousands and 01, actually KZT14\r\nmillions and 860 thousands were recovered.
