International Foundation for Protection of Freedom of Speech «Adil Soz» has conducted analysis of\r\nviolations of right to freedom of expression, receiving and dissemination of\r\ninformation in October, 2016 in Kazakhstan.

There was following information:
\r\n\r\n
-Esil District Court № 2 of Astana has sentenced Seitkazy Matayev to six\r\nyears of deprivation of liberty, Aset Matayev to five years of deprivation of\r\nliberty. Lawyers of Matayevs stated about violations of the law which were\r\nadmitted in case over charge of Matayevs. The condemnatory judgment will be appealed\r\nin court of appellate instance.
\r\n\r\n
-The Chairman of Public Association «Adilet»\r\nAmangeldy Batyrbekov has been again brought to criminal responsibility. He was charged\r\nwith slander with regard to prosecutor and knowingly false information.
\r\n\r\n
-The director Talgad Zhanybekov was found guilty in slander with regard\r\nto Minister of Culture and Sport of the Republic of Kazakhstan Arystanbek\r\nMukhamediuly.
\r\n\r\n
In October, 2016 three judicial acts towards cases over protection of\r\nhonour, dignity and business reputation were passed. And, zero in favour of media\r\noutlets, journalists and citizens.
\r\nSince the beginning of the year\r\nin connection with execution of right to freedom of expression, receiving and\r\ndissemination of information, they were brought:
\r\n-47 charges with slander (23 –\r\npassing data, Amangeldy Botabekov; 22 lectures of Institute of Economy and\r\nLaw);
\r\n-2 charges with propaganda or\r\npublic calls on forced seizure of power;
\r\n-9 charges with incitement of\r\nsocial, religious and national enmity (article 174 of Criminal Code of the\r\nRepublic of Kazakhstan); 3 of them are passing data S. Mambetalin, E. Narymbaev\r\nand E. Thaichibekov;
\r\n-1 charge with propaganda of\r\nterrorism (passing data, B. Satkangulov);
\r\n-12 charges with dissemination\r\nof misleading information (article 274 of Criminal Code of the Republic of\r\nKazakhstan. 1 of them – JSC «KAZKOMMERTSBANK»\r\nagainst journalists of Internet-portal NAKANUNE.kz);
\r\n-1 charge with evasion of the\r\npayment of taxes;
\r\n-1 charge with embezzlement of\r\nentrusted of the other property;
\r\n-2 charges with fraud;
\r\nAnd etc.
\r\n-71 pre-trial claims and suits\r\non protection of honour, dignity and business reputation
\r\nFrom January-October, courts passed 38 judicial acts of suits on\r\nprotection of honour, dignity and business reputation (in first instance- 26)\r\nin the total amount of KZT736 millions 460 thousands and 01, actually KZT46\r\nmillions and 260 thousands were recovered.
