Violations of freedom of speech in Kazakhstan August, 2015 (Digest)

International Foundation for Protection of Freedom of Speech "Adil Soz" has conducted a survey of violations of right to freedom of expression, receiving and dissemination of information in August, 2015 in Kazakhstan.

There was following information

-Pre-trial investigation towards case of editor of newspaper «Version» Yaroslav Golyshkin was finalized. It was provided for him and his lawyer for introduction. 

-The criminal case was opened with regard to entrepreneur from Taraz Ermek Thaichibekov.  He was charged with incitement of social, national, tribal, racial and religious enmity;and institutionalized to the Applied Research Centre of Psychiatry, Psychotherapy and Narcology in Almaty. The charges originated from his posts in social networks, where he stated for  exacerbation of the political relationships of Kazakhstan and Russia. 

-The publication of magazine «ADAM»was suspended during three months. 

-The Appellate instance has upheld court decision on recovery of KZT20000000 from owner of domain name www.nakanune.kz in favour of JSC «KAZKOMMERTSBANK»

In August, four judicial acts of earlier considered cases over suits on protection of honour, dignity and business reputation were passed. They also, included three in appellate instance and one in cassation instance; two of them in favour of journalists and citizens. 

Since the beginning of the year in connection with execution of right to freedom of expression, receiving and dissemination of information, they were brought: 

-11 charges with slander (incl. passing data – 2); 

-7 charges with incitement of national enmity (article 174 of Ciminal Code of the Republic of Kazakhstan); 

-7 charges with dissemination of misleading information (article 274 of Criminal Code of the Republic of Kazakhstan). 

-66 pre-trial claims and suits on protection of honour, dignity and business reputation. 

From January, courts considered 35 cases over suits on protection of honour, dignity and business reputation in the total amount of KZT390millions and 400 thousands.
