International Foundation for Protection of\r\nFreedom of Speech \"Adil Soz\"\r\nhas conducted a survey of violations of right to freedom of expression,\r\nreceiving and dissemination of information in August, 2015 in Kazakhstan.
\r\nThere was following information
\r\n-Pre-trial investigation towards case of editor\r\nof newspaper «Version» Yaroslav Golyshkin was finalized. It was provided\r\nfor him and his lawyer for introduction.
\r\n-The criminal case was opened with regard to\r\nentrepreneur from Taraz Ermek Thaichibekov. \r\nHe was charged with incitement of social, national, tribal, racial and\r\nreligious enmity;and institutionalized to the Applied Research Centre of\r\nPsychiatry, Psychotherapy and Narcology in Almaty. The charges originated\r\nfrom his posts in social networks, where he stated for exacerbation of the political relationships of\r\nKazakhstan and Russia.
\r\n-The publication of magazine «ADAM»was suspended during three months.
\r\n-The Appellate instance has upheld court decision\r\non recovery of KZT20000000 from owner of domain name www.nakanune.kz in\r\nfavour of JSC «KAZKOMMERTSBANK».
\r\nIn August, four judicial acts of earlier considered cases over suits on\r\nprotection of honour, dignity and business reputation were passed. They also,\r\nincluded three in appellate instance and one in cassation instance; two of them\r\nin favour of journalists and citizens.
\r\nSince the beginning of the year in connection with execution of right to\r\nfreedom of expression, receiving and dissemination of information, they were\r\nbrought:
\r\n-11 charges with slander (incl. passing data – 2);
\r\n-7 charges with incitement of national enmity (article 174 of Ciminal\r\nCode of the Republic of Kazakhstan);
\r\n-7 charges with dissemination of misleading\r\ninformation (article 274 of Criminal Code of the Republic of Kazakhstan).
\r\n-66 pre-trial claims and suits on protection of\r\nhonour, dignity and business reputation.
\r\nFrom January, courts considered 35 cases over suits on protection of\r\nhonour, dignity and business reputation in the total amount of KZT390millions\r\nand 400 thousands.
