Supervisory Collegiums left sentence for Chief Editor of “Alma-ata Info” Ramazan Yesergepov standing

On December 14, 2009 Supervisory Collegiums of Zhambyl Regional Court examined an appeal of sentence of court №2 of Taraz by case of Chief Editor of independent weekly “Alma-ata Info” Ramazan Yesergepov. The court did not find any motives for institution of supervisory proceeding and left sentence standing.

Criminal case was brought against Ramazan Yesergepov in January 2009.Yesrgepov was found guilty under articles 172 p.1 and 339 p.2 of Criminal Code of the Republic of Kazakhstan. He was sentenced to three years of imprisonment in standard regime penal colony in January 2009. Yesergepov could not make editorial activity during two years after his imprisonment. Court of Appeal Instance left the sentence standing.

The charges stemmed from article “Who does rule country- President or CNS?” by Ramazan Yesergepov, published in the newspaper Alma-ata Info” on November 21, 2008. There was publication of the letter of Head of Zhambyl Regional Department of Committee of National Security to Chairman of CNS Amangeldy Shabdarbayev. There was an opening of criminal case against company “Taraz” and founder of company Sultan Makhmadov has tried to meet with President of Kazakhstan Nursultan Nazarbayev with goal to influence on investigative process.

On August 08, 2009 court №2 of Taraz took incriminated charges of Ramazan Yesergepov as proved ones and committed him to three years of imprisonment in standard regime penal colony. He could not make editorial activity during two years after his imprisonment. Court of Appeal Instance left the sentence standing.

Kazakhstan’s and international community made an attempt to protect convicted journalist. So, Representative Officer of Mass Media of OSCE Miklosh Kharashti made a statement of non-admittance of Ramazan Yesergepov’s conviction. Criminal sanctions for failure of secret should be used for state officials in accordance with democratic standards of freedom of speech. They should keep state secrets.
