Inсitement or opinion?
Another trial on incitement of hatred will begin soon. The accused made five reposts in social network Vkontakte. The prosecutor claims that it obviously was a crime against peace and safety of the mankind. One expert found signs of inciting religious hatred in publications. The other came to the conclusion that the author informed his followers of the hostile goals of the banned ISIL in Kazakhstan and warned young, uneducated people against the danger of joining the group.
Why do the experts of the sam field came to diametrically opposite conclusions? The main reason is the lack of a unified methodology for expert research (in addition to a number of secondary and subjective reasons) .
What should the methodology be? Experts of the center of forensic exminations of the Ministry of Justice, independent researchers, scientists of leading universities of the country and lawyers are discussing this issue today at the round table.
The round table “Expert study of signs of incitement to hatred: discussing the draft methodology” is the next stage in the implementation of the project “Promoting freedom of expression on issues of national, religious, social relations in Kazakhstan”. It is managed by the Adil Soz Foundation in partnership with the Center of Forensic Examinations of the Ministry of Justice of the Republic of Kazakhstan and supported by the mission of the Kingdom of the Netherlands to the OSCE, the Soros-Kazakhstan Foundation, the Embassy of the Kingdom of the Netherlands in Kazakhstan, the OSCE Program Office in Astana.
Unlike before, we didn’t invite journalists to this event, the issue is too complicated, it's hard to understand much at once, even with the use of press releases. But we will welcome our colleagues at the presentation of the methodology!
