Board of Appeals of Oblast Court has dismissed judgment of Uralsk City Court related to recovery of KZT20000000 (1USD=145.60) from newspaper "Uralskaya Nedelya" and journalist Zamira Kosmurzieva as moral damage for LLP "CME Metalloizdeliya"

Board of Appeals of Oblast Court has dismissed judgment of Uralsk City Court related to recovery of KZT20000000 (1USD=145.60) from newspaper "Uralskaya Nedelya" and journalist Zamira Kosmurzieva as moral damage for LLP "CME Metalloizdeliya". There were amendments in Civil Code of the Republic of Kazakhstan on April 16, 2011. Legal entities were deprived from rights to demand the moral damage compensation.
The charges stemmed from article "What is akim (governor) worried about?" by Zamira Kosmurzieva, which was published in the newspaper "Uralskaya Nedelya" on November 11, 2010. There was information on construction process of the object "Intellectual School of First President of the Republic of Kazakhstan of Physics and Mathematics Profile" where LLP "CME Metalloizdeliya" has been general contractor. Servicemen of LLP "CME Metalloizdeliya" disputed some fragments, related to their problems with tax bodies, professional activity of the company. They demanded to publish the disclaimer and recovery of KZT30000000 (1USD=145.60) as moral damage compensation.
