Violations of Freedom of Speech in Kazakhstan April 2022

The International Foundation for the Protection of Freedom of Speech "Adil Soz" conducted a study of the situation with the right to freedom of expression, receipt and dissemination of information in Kazakhstan in April 2022.

 

Itreports:

- The bill "On Amendments and Additions to Certain Legislative Acts on the Protection of the Rights of the Child, Education, Information and Informatization" has been submitted to the President for signature.

As it was reported the initial noble idea of the bill was to protect children from kiberbulling. But it implied so many restrictions that freedom of expression was put at threat. The authors of the bill, MPs Aidos Sarym and Dinara Zakieva, gave the authorized body (the ministry of information and public development - MIPD) the right  to restrict or suspend the work of websites, social networks and instant messengers at its own discretion access .

The Senate (the upper chamber of the Parliament), where the bill was sent after unanimous approval by the Mazhilis (the lower chamber of the Parliament), limited this arbitrariness. It proposed,  to create an expert commission to define cyberbullying, and to delete cyberbullying content only.

On April 20, the Mazhilis adopted those amendments. At the same time, Mazhilis speaker Yerlan Koshanov bowed and scraped before Aidos Sarym and Dinara Zakieva, who made hard efforts to tighten control over the public Internet.

The rules that the owners of Facebook, Instagram, LinkedIn and other popular resources must appoint their representatives and within 24 hours delete content that MIPD recognized  as cyberbullying have been preserved.

 

- Parliament introduced new rules of conduct for media.  Journalists view those rule as restricting their work in parliament. The Union of Journalists of Kazakhstan and the International Foundation for the Protection of Freedom of Speech "Adil Soz" addressed the Speakers of both chambers of the Parliament and the Minister of Information and Social Development with an open letter "On the inadmissibility of restricting the work of journalists in Parliament."

The letter says:

The deputies of the Mazhilis (lower chamber) and the Senate of the Parliament once again decided to teach journalists communication standards when interacting with the deputies. The new rules of conduct for journalists in the parliament have been adopted for this purpose,” explained Yedil Zhanbyrshin, Mazhilis deputy and the initiator of the rules. Other MPs supported the idea. 

According to the deputies observing communication standards assumes that journalists are NOT able to:

- show the public deputies during parliamentary sessions (now cameramen and photographers can work in the meeting room for the first 10 minutes of the session only). It turns out that earlier cameramen obstructed the MPs work on the bills. Besides 10 minutes – is the time when MPs are able  to sit still without looking at their mobile phones and without yawning;

- to interview MPs individually (now journalists will crowd around a single  microphone behind a red ribbon). That gives an excellent opportunity to “mishear”  unpleasant questions;

- run after the deputies, trying to catch them at the elevators and in the buffets in attempts to get information. Now MPs don’t have to hide from microphones, they can simply pass by, as if there are no media around.

The Upper House of Parliament went even further in forcing journalists to follow communication standards. The Senate press center was moved to the basement, where there is no mobile connection, there are not enough working space, but a lot of various smells from the nearby canteen.

We would like to remind the respected deputies the words of the President of the country K. Tokayev said in his recent Address “New Kazakhstan: the path of renewal and modernization”: “The state will pay special attention to the creation of an open information space, popular and strong media. Media represents an effective channel of communication between the authorities and the people, so media can and should raise pressing issues.”

We believe that adopting these rules is a manifestation of disrespect for media as a public institution that performs the most important social functions, and for journalists as media employees. We ask you to cancel the new rules as limiting the right of the public to receive reliable information and preventing promoting of the public’s trust in the authorities».

On April 19, Senate spokesperson Daniyar Ramazanov shared the good news - the Senate press center was moved back to its original location.

He assured that  briefings would be held in the hall near the meeting room, and the technical service is already setting the  equipment on the site.

 

- The investigation into the assassination attempt on journalist Amangeldy Batyrbekov has been extended until the end of May.

Five people are targeted in the investigation, including assassin's paymaster, the middlemаn and three assassins.

According to investigators, the suspected assassin's paymaster  is Bauyrzhan Mayrikhov, who was the head of the education department of the Saryagash district of the Turkestan region.

Sabyrkhodzha Moldakhodzhaev, born in 1985 is suspected of finding and hiring assassins. According to Ratel.kz, he has been  a practicing psychologist in the Saryagash region for a long time.

Three residents of the region - Abdukhamid Kuandykov, born in 1988, Meirzhan Dosbolov, born in 1996, Nurgali Kydyraliev, born in 2000 are are targeted in the investigation as suspects in the assassination attempt. They are charged not only with contracted murder attempt but with illegal keeping of weapons as well.

As it was reported, that the attempted murder of Amangeldy Batyrbekov took place on the night of January 4 in the city of Saryagash. Unidentified people opened fire and wounded Batyrbekov's son Dinmukhamed near the house of the editor of the newspaper "Saryagash info" .

 

- The investigation on Interfering with legal professional activity of Khabar-24 TV journalists was dropped and resumed for the third time .

 “The police quietly dropped the case on April 4 under Article 35, Part 1, Clause 2 of the Code of Criminal Procedure of the Republic of Kazakhstan - due to the absence of a criminal event. They even didn't tell me anything. Well, the score is 2 : 2 Two times the case was dropped by the prosecutor's office, twice by the police. I have already got used to this Yo-Yo. I wonder what will be the final score, or this lawlessness is endless. How much can you bring the score to, eh, Prosecutor’s Office of the Nothern Kazakhstan Region?” Tolegen Imanov, the affected cameraman of the Khabar 24 TV channel, wrote on Facebook.

Some time after the information was posted in social networks, the prosecutor's office of the North Kazakhstan region canceled the decision to drop the pre-trial investigation.

 

The following charges were filed in connection with the exercise of the right to freedom of expression in April 2022:

- 1 criminal charge (0 in court)

- 2 civil claims and lawsuits (1 of them for protection of honor, dignity and business reputation).

- 1 administrative charge

The following charges were filed since the beginning of the year:

- 11 criminal charges (3 in court).

- 10 claims and suits in civil procedure (9 of them for protection of honor, dignity and business reputation).

Claims for compensation for non-pecuniary damage amounted to 6 million 450 thousand  tenge. The courts collected 500 thousand tenge.

- 11 administrative charges, including 7 related to January riots
