Violations of Freedom of Speech in Kazakhstan May 2021

The International Foundation for the Protection of Freedom of Speech "Adil Soz" conducted a study of the situation with the right to freedom of expression, receipt and dissemination of information in Kazakhstan in MayMarch 2021.

It reports

- "Adil Soz" published an analysis of a bill developed by the Ministry of Digital Development, Innovation and Aerospace Industry of the Republic of Kazakhstan that introduces a "right to be forgotten", and a ban on virtual private networks.

Human rights activists believe that the proposed bill does not meet the requirements of proportionality and necessity for a democratic state to protect constitutionally significant values, as well as public interests in the field of access to information.

- The Committee of Information of the Ministry of Information and Social Development of Kazakhstan demanded that Village.kz delete the news telling about the word  “Cancel” written on the mural depicting the ex-president of the country N. Nazarbayev.

On May 28, The Village.kz editors received an e-mail from the Information Committee of the Ministry of Information and Social Development of Kazakhstan. It demanded to delete  the news about the word  “Cancel” wrtitten on the mural depicting ex-president of the country N. Nazarbayev. The Committee believed that the news website posted information that “dishonored the image of the First President of the Republic of Kazakhstan”. The Information Committee said in its letter that the editors violated  the norms of Kazakhstani legislation related to the honor and dignity of the First President of the Republic of Kazakhstan, as well as the norms of the Facebook community, that do not allow bullying and harassment. Besides it warned of respective criminal and administrative liability.

The editorial board did not delete the news, but took into account the requirements of the Committee: the controversial image in the news was blurred and an explanatory editorial note was added at the beginning of the article.

 

- An unknown man set upon  journalist Oksana Matasova with blows in Kokshetau.

One of the residents of Kokshetau complained to the news website "716.kz" that her 14-year-old son was hired for beautification of the city lake Kopa. The employer did not sign an agreement with him and cheated him with payment.

On May 26, journalist Oksana Matasova arrived at the place of works and made a video of children who were cleaning the irrigation canal.

Soon an unknown man approached her, the journalist greeted him and introduced herself. In response, the stranger,  cursed her out and attacked her with fists, demanding that she leave the site.

The reporter  had to retreat to a safe distanceunder the onslaught of threats. After the story was published on the 716.kz, the police called Matasova, and she filed a complaint to the law enforcement agencies asking taking action against the attacker  for “Petty hooliganism”, “Interferring with the  professional activity of a journalist” and “Insult”.

 

- Temirlan Ensebek, the administrator of satirical Instagrampublic QazNews24 became a witness with the right to defense in the case of disseminating deliberately false information. The jokes posted on the public were the reason for investigation.

"The information posted on this account caused an ambiguous reaction from the public, as it misinformed citizens," said a message published on the Polisia.kz website.

On May 15, a search was carried out in Temirlan's house in the absence of a lawyer. The police seized office equipment. After the search, the activist was taken for interrogation to the Almaty police department, where he spent about five hours. The police made him sign an  agreement of non-disclosure the investigation data.

While interrogated, Temirlan Ensebek  admitted authorship of the Instagram page, but pleaded not guilty: “It was clearly written on the page  that all coincidences with people and events are an absolute coincidence, the news are fake and the content is satirical . I cannot be considered a criminal . The article 274 of the  Criminal code is called "dissemination of deliberately false information". I did not deliberately disseminate any  false information. "

 

Six  judicial acts was  issued against media in connection with the exercise of the right to freedom of expression , the receipt and dissemination of information in May 2021. Four of them were  in  favor of defendants.

 

The following charges were filed  in connection with the exercise of the right to freedom of expression:

- 2 criminal charges (including 1 in court)

- 3 civil  claims and lawsuits (all of them for protection of honor, dignity and business reputation).

- 2  administrative charges (including 1 slander charge)

 

The following charges were filed since the beginning of the year:

 

- 14  criminal charge (7  in court).

- 27  claims and suits in civil procedure (25 of them for protection of honor, dignity and business reputation).

Claims for compensation for non-pecuniary damage amounted to 16  million 500 thousand tenge. The courts collected 450 thousand  tenge.
