International Foundation\r\nfor Protection of Freedom of Speech \"Adil Soz\" has conducted a\r\nsurvey of violations of right to freedom of expression, receiving and\r\ndissemination of information in January, 2016 in Kazakhstan.
\r\nThere was following\r\ninformation:
\r\nNew Civil Procedural Code, Law “On Amendments of\r\nImprovement of System of Administration of Justice of the Republic of\r\nKazakhstan”, Law “On Amendments and Supplements into Some Legislative\r\nActs of Informatization of the Republic of Kazakhstan” and etc came into effect.
\r\nThe Appellate Instance has quashed sentence. Earlier,\r\nChairman of Public Association “Adilet”\r\nAmangeldy Batyrbekov was sentenced to one year and six months and was\r\ncharged with slander.
\r\nDefendants in the criminal case over dissemination of\r\nmisleading information on “KAZKOMMERTSBANK”Makhambet Utemisov and Rafael\r\nBalgin have apologized to the bank.
\r\nThe Head of Public Association Bolatbek Blyalov was\r\nsentenced to three years of deprivation of liberty for commission of deliberate\r\nacts aimed at inciting of social and national enmity.
\r\nCivil activists Serikzhan Mambetalin and Ermek\r\nNarymbaev were found guilty in incitement of national enmity.
\r\nThe Committee of National Security of the Republic of Kazakhstan\r\ndemanded all information on agencies of national security should agree with its\r\npress service. Later, Committee of National Security stated, that it did not\r\nuse censorship with regard to media outlets.
\r\nIn January, two judicial\r\nacts of cases over suits on protection of honour, dignity and business\r\nreputation were passed (including one in appellate instance); one of them in\r\nfavour of journalists and citizens.
\r\nSince the beginning of the year in connection with execution of right to\r\nfreedom of expression, receiving and dissemination of information, they were\r\nbrought:
\r\n-3 charges with slander (1 – passing data, Amangeldy Botabekov)
\r\n-4 charges with incitement of social, religious and national enmity\r\n(article 174 of Criminal Code of the Republic of Kazakhstan); 2 of them are\r\npassing data S. Mambetalin and E. Narymbaev;
\r\n-3 charges with dissemination of misleading information (article 274 of\r\nCriminal Code of the Republic of Kazakhstan). 1 of them JSC “KAZKOMMERTSBANK”\r\nagainst journalists of Internet-portal NAKANUNE.kz.
\r\n-10 pre-trial claims and suits on protection of honour, dignity and\r\nbusiness reputation.
\r\nFrom January, courts considered 6 cases over suits on protection of\r\nhonour, dignity and business reputation in the total amount of KZT56 millions\r\n500 thousands and 01.
