Violations of freedom of speech in Kazakhstan. October, 2015 (Digest)

International Foundation for Protection of Freedom of Speech "Adil Soz" has conducted a survey of violations of right to freedom of expression, receiving and dissemination of information in October, 2015 in Kazakhstan. 

There was following information: 

- The journalist Bota Zhumanova was beaten in Almaty. A person, who was suspected in commission of crime, he was detained.

- The Head of Public Association«Adilet» Amangeldy Batyrbekov was sentenced to one year and six months. He was charged with slander.

- The administrator of group in social network «VKontakte» was charged with separatism. He has admitted enquiry to publication.

- The magazine«ADAM»was recognized «united media». It was closed, according to court decision.

-Websites Ratel.kz and Zonakz.net have been out of access. Reasons of blocking have been  strange.

-The academician Zhasan Zekeiuly has demanded to suspend publication of newspaper  «Zhas Alash»during six months and recover KZT400000000 as moral damage compensation.

 

In October, five judicial acts of cases over suits on protection of honour, dignity and business reputation were passed (including three in appellate instance and  one in cassation instance; two of them in favour of journalists and citizens. 

Since the beginning of the year in connection with execution of right to freedom of expression, receiving and dissemination of information, they were brought: 

-12 charges with slander; 

-9 charges with incitement of national enmity (article 174 of Criminal Code of the Republic of Kazakhstan); 

-1 charge with propoganda of terrorism (article 256 of Criminal Code of the Republic of Kazakhstan).

 -1 charge with separatism (Article 180 of Criminal Code of the Republic of Kazakhstan) 

-82 pre-trial claims and suits on protection of honour, dignity and business reputation. 

From January, courts considered 41 cases over suits on protection of honour, dignity and business reputation in the total amount of KZT854millions and 400 thousands.
