International\r\nFoundation for Protection of Freedom of Speech \"Adil\r\nSoz\"\r\nhas conducted a survey of violations of right to freedom of\r\nexpression, receiving and dissemination of information in September,\r\n2015 in Kazakhstan.
\r\nThere\r\nwas following information:
-New\r\nCivil Procedural Code which expanded the publicity of judicial\r\nprocedure and regulated sum of recovery of moral damage towards suits\r\non protection of honour and dignity was submitted to President of\r\nKazakhstan, in order to sign it.\r\n
\r\n-In\r\nPavlodar, trial on extortion of USD500000 from oblast akim (governor)\r\nwas launched. The editor of newspaper “Version”\r\nYaroslav\r\nGolyshkin was charged with it.
\r\n-The\r\ncourt has imposed on recovery of owner of magazine «ADAM»and\r\nits editor-in-chief KZT50000000\r\nas moral damage compensation in favour of Chairman of Committee of\r\nNational Security of the Republic of Kazakhstan Kabdulkarim\r\nAbdikazimov.
\r\n-Board\r\nof Appeals has upheld rule of administrative court on suspension of\r\npublication of magazine “ADAM”.
\r\n-The\r\nJudge of Almalinsk District Court (Almaty) K. Bukhbanova asked\r\njournalists to leave two open trials.
\r\n-\r\nratel.kz\r\nand\r\nZonakz.net have\r\nbeen out of access for Kazakhstan\'s Internet-users. Nobody knew about\r\nreasons of blocking.
\r\nIn\r\nSeptember, two judicial acts of earlier considered cases over suits\r\non protection of honour, dignity and business reputation were passed\r\nand one in cassation instance; zero of them in favour of journalists\r\nand citizens.
\r\nSince\r\nthe beginning of the year in connection with execution of right to\r\nfreedom of expression, receiving and dissemination of information,\r\nthey were brought:
-11\r\ncharges with slander (incl. passing data – 2);
-8\r\ncharges with incitement of national enmity (article 174 of Criminal\r\nCode of the Republic of Kazakhstan);
-8\r\ncharges\r\nwith dissemination of misleading information (article 274 of Criminal\r\nCode of the Republic of Kazakhstan).
-72\r\npre-trial\r\nclaims and suits on protection of honour, dignity and business\r\nreputation.
From\r\nJanuary, courts considered 37 cases over suits on protection of\r\nhonour, dignity and business reputation in the total amount of\r\nKZT450millions and 400 thousands.
