Violations of freedom of speech in Kazakhstan July, 2015 (Digest)

International Foundation for Protection of Freedom of Speech "Adil Soz" has conducted a survey of violations of right to freedom of expression, receiving and dissemination of information in July, 2015 in Kazakhstan.

 

There was following information: 

Petropavlovsk City Court has sentenced a 22-years-old resident of Petropavlovsk Alkhanashvili to three years of imprisonment; he published and disseminated materials which incited national enmity, hatred and violated national feelings of representatives of the other ethnic groups in various social networks.

Uralsk City Court has found guilty resident of Uralsk M. Suleymenov in commission of crime under article 174 p. 1 “Incitement of national, tribal, racial or religious enmity” of Criminal Code of the Republic of Kazakhstan with usage of media or information and communication networks and sentenced to three years of deprivation of liberty with probation supervision for the whole period.

The court has extended arrest of journalist Y. Golyshkin before the 14th August, 2015.

Editorial staff of the website www.nakanune.kzinformed about probable provocation with regard to Guzyal Baidalinova.  

The Prosecutor of Shardarinsk District (South Kazakhstan Oblast) Talgat Seidualiev has charged with slander journalist Ramziya Yunusova. 

Police wanted a spreader of video with pictures of natural calamity which took a place in other country and it was misrepresented as video of mudflow which took a place in Almaty. 

Board of Appeals has acquitted journalist Nargiz Severnaya.

In July, six judicial acts of earlier considered cases over suits on protection of honor, dignity and business reputation were passed. They also, included two in appellate instance and one in cassation instance; five of them in favor of journalists and citizens.

Since the beginning of the year in connection with execution of right to freedom of expression, receiving and dissemination of information, they were brought:

- 11 charges with slander (incl. passing data – 2);

- 6 charges with incitement of national enmity (article 174 of Criminal Code of the Republic of Kazakhstan);

- 5 charges with dissemination of misleading information (article 274 of Criminal Code of the Republic of Kazakhstan).

- 61 pre-trial claims and suits on protection of honor, dignity and business reputation.

From January, courts considered 29 cases over suits on protection of honor, dignity and business reputation in the total amount of KZT388millions and 400 thousands.
