International\r\nFoundation for Protection of Freedom of Speech \"Adil\r\nSoz\" has\r\nconducted a survey of violations of right to freedom of expression,\r\nreceiving and dissemination of information in June, 2015 in\r\nKazakhstan.
\r\nThere\r\nwas following information: \r\n
- The\r\nlawyer of arrested editor of newspaper «Version»Yaroslav\r\nGolyshkin has told about violation of right for protection during\r\ninvestigative procedure.\r\n
-The\r\npublic figure Murat Telibekov has become suspected person in\r\ncommitment of crime under article 174 “Incitement of social,\r\nnational, tribal and religious enmity” of Criminal Code of the\r\nRepublic of Kazakhstan.\r\n
-The\r\nadministration of school demanded recovery of KZT10000000 as\r\ncompensation of moral damage from newspaper «Version»\r\nwhich\r\npublished its article one year ago.\r\n
-The\r\ncourt of first instance has recovered KZT2000000 from owner of\r\nwebsite «Nakanune.kz»:\r\nGuzyal Baidalinova in favour of JSC «Kazkommertsbank».
In June,\r\n four judicial acts of earlier considered cases over suits on\r\n protection of honour, dignity and business reputation were passed.\r\n They also, included one in appellate instance; two of them in favour\r\n of journalists and citizens. \r\n
Since the\r\n beginning of the year in connection with execution of right to\r\n freedom of expression, receiving and dissemination of information,\r\n they were brought: \r\n
- 10 charges\r\n with slander (incl. passing data – 2); \r\n
- 3 charges\r\n with incitement of national enmity;
\r\n - 3 charges with dissemination of\r\n misleading information (article 274 of Criminal Code of the Republic\r\n of Kazakhstan).
\r\n - 54 pre-trial claims and suits on\r\n protection of honour, dignity and business reputation. \r\n
From\r\nJanuary, courts considered 26 cases over suits on protection of\r\nhonour, dignity and business reputation in the total amount of\r\nKZT388millions and 100 thousands.\r\n
